These Terms of Use ("Terms") govern your use of the Giftn website at giftn.app and the Giftn app preview (together, the "Service"), operated by Giftn's founder in the United States ("Giftn," "we," "us"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
Giftn is in active development. The app preview is provided so you can explore how Giftn works using sample data. Product listings, prices, ratings, and review counts shown in the gift finder and shop are demonstrations only — they are not live offers, and retailer links are currently disabled. Nothing in the Service is an offer to sell goods, and no purchases can be made through the Service today.
The Giftn name, logo, interface, and original content are owned by Giftn and protected by applicable intellectual-property laws. Third-party retailer and product names are the trademarks of their respective owners; their appearance in the Service is for identification and demonstration and does not imply endorsement of Giftn by those companies.
When retail partnerships launch, retailer links in the Service will take you to third-party websites. Your purchases on those sites are made with the retailer, not with Giftn, and are governed by the retailer's own terms, pricing, and policies. Giftn may earn a commission on qualifying purchases, as described in our Affiliate Disclosure. We are not responsible for the availability, accuracy, pricing, or fulfillment of any third-party product or site.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that sample data reflects real products or prices.
To the fullest extent permitted by law, Giftn will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed fifty U.S. dollars ($50).
We may modify or discontinue the Service at any time, and we may update these Terms as Giftn evolves. The current version will always be posted at giftn.app/terms/ with its "last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the United States and the state in which Giftn's operator resides, without regard to conflict-of-law rules.
